Standards-of-care, the guide rails which determine a doctor’s choice of treatment for their patients, inherently lag behind truly innovative therapies which could disrupt the medical landscape. Unfortunately, if a doctor or a patient wishes to explore such therapies nowadays, liabilities due to potential lawsuits discourage these options.

 

The law SB 171 arose out of the desire to protect the doctor-patient relationship through the use of private contracts. The contract requires a sound therapeutic basis for the treatment, including fully informed consent of the benefits as well as the potential side effects. If it adheres to these steps, the doctor and the patient can explore options beyond the standard-of-care.
